Welcome to eprivate ltd , we are a UK-based company. By purchasing or
using our second-hand products or software , you agree to be bound by these
Terms of Service. Please read them carefully.
Nature of Products:
All physical products sold by eprivate ltd are second-hand and sold "as is" without
warranties, except as required by UK law (e.g., Consumer Rights Act 2015). Products may
have wear, defects, or limited functionality, and it is your responsibility to review product
descriptions and conditions prior to purchase. Software is licensed, not sold, under the terms
of the applicable software licence agreement provided at purchase.
Sales, Returns, and Refunds:
Second-Hand Products: All sales of second-hand products are final, except where UK law
mandates otherwise (e.g., if the product is not as described or is faulty). Returns or refunds
are not accepted for change of mind or minor wear consistent with the product’s
second-hand condition. Any return requests must be submitted in writing to [email protected]
within 14 days of delivery, as per the Consumer Contracts Regulations 2013 for distance
sales, where applicable.
Software: Software licences are non-returnable and non-refundable, except where the
software is faulty or not as described, as required by UK law. You acknowledge that software
functionality may be limited due to its second-hand or legacy nature.
Software Licensing and Restrictions:
Software provided by eprivate ltd is subject to the accompanying end-user licence
agreement (EULA). You are granted a non-exclusive, non-transferable, revocable licence to
use the software for personal or agreed commercial purposes, as specified in the EULA.
You may not copy, modify, reverse-engineer, decompile, distribute, or sublicense the
software, except as permitted by law. Unauthorised use may result in termination of your
licence and legal action.
Software is provided "as is" without warranties, except for statutory rights under UK law
(e.g., that it meets the description and is of satisfactory quality).
No Additional Warranties:
Except as required by UK law, we make no warranties, express or implied, regarding the
condition, functionality, or performance of second-hand products or software, including but
not limited to merchantability or fitness for a particular purpose. Product descriptions,
images, or specifications are for informational purposes only and do not constitute a
guarantee.
Limitation of Liability:
To the fullest extent permitted by UK law, eprivate ltd shall not be liable for any
indirect, incidental, consequential, or special damages arising from your purchase or use of
our Products, including but not limited to loss of data, profits, or property damage. Our total
liability, if any, shall not exceed the amount paid by you for the Product. Nothing in these
Terms excludes or limits liability for death, personal injury, fraud, or any other liability that
cannot be excluded under UK law.
Claims and Disputes:
Any claims must be submitted in writing to [email protected] within seven (7) days of delivery
or, for software, within seven (7) days of licence activation, unless a longer period is required
by UK law. We reserve the right to deny claims at our discretion, except where prohibited by
law. Disputes shall be resolved through negotiation or, if necessary, binding arbitration in London, England, under the rules of the London Court of International Arbitration. You waive
the right to participate in class actions, to the extent permitted by law.
Consumer Rights:
If you are a consumer under UK Law, nothing in these Terms afects your statutory rights,
including those under the Consumer Rights Act 2015 (e.g., that goods must be as described,
of satisfactory quality, and fit for purpose) or the Consumer Contracts Regulations 2013 for
distance sales (e.g., 14-day cooling-off period for online purchases).
Governing Law:
These Terms are governed by the laws of England and Wales. Any disputes shall be subject
to the exclusive jurisdiction of the courts of England and Wales, except where UK consumer
law allows you to bring claims in your local jurisdiction.
Changes to Terms:
We may update these Terms at any time by posting the revised version on our website.
Continued use of our Products after such changes constitutes your acceptance of the
updated Terms.
